Linkella Terms of Service
These policies are not yet effective. Live checkout is not open.
Linkella is in pre-launch. Subscription, publishing and audience provisions apply when those services become available; they do not imply live checkout is open today.
1. Who provides Linkella
Linkella is operated by Ruchir Harbhajanka, an individual based in India, referred to as “Linkella”, “we” or “us”. Our public correspondence address is Astra Towers, ANO 616, Action Area II C, Rajarhat, New Town, Kolkata - 700161, India. Contact [email protected] for support, privacy, complaints or legal notices.
These Terms govern the Linkella website, accounts and software, including profile publishing, supported media and forms, analytics, QR codes and short links. By expressly accepting these Terms when creating an account or purchasing access, you enter an agreement with the operator. Someone accepting for a business must have authority to bind it. Visitors must follow the content and misuse rules applicable to their activity.
The Acceptable Use and Fair Use Policy and Refund and Cancellation Policy form part of this agreement. The Privacy Policy and Cookie Notice explain data practices; accepting these Terms is not blanket consent to marketing or optional tracking. The DPA applies where we process audience data for you under that addendum.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter this agreement. Provide accurate account and billing information. Keep your credentials secure, use available security controls and tell us promptly about suspected unauthorised access. You are responsible for activity you authorise, but not for failures for which applicable law makes us responsible.
Choose a profile name you are entitled to use. Do not impersonate someone, infringe a mark, or register names mainly to extort another person. A profile name is not a trademark registration or ownership of a domain. We may address competing rights or misleading names fairly and explain any restriction where permitted.
Accounts and permissions belong to the relevant account holder. Do not share owner credentials as a substitute for an authorised collaboration feature. Team management and custom domains are not included in the current Plus offer.
3. Your pages and content
You retain ownership of your text, media, branding and other content. You give us a nonexclusive, worldwide, royalty-free licence to store, copy, technically adapt, transmit and display that content only as needed to provide, secure and support Linkella and carry out your instructions. This includes resizing images, generating delivery variants and serving public pages. We may engage service providers for those purposes under appropriate obligations.
This licence does not authorise unrelated advertising using your content or training general-purpose AI models on it. We will obtain separate permission before featuring your page or identity in our promotional materials. Necessary retention for backups, legal obligations or disputes follows the Privacy Policy; retained copies are not a licence for new commercial uses.
You must hold the rights, permissions or lawful exceptions needed for your content, imports, screenshots, logos, photographs, embedded material and linked destinations. Public availability, attribution or a successful import does not establish permission. Applicable copyright exceptions remain available as explained in the Acceptable Use Policy.
You choose what to publish. Saving a draft does not make it public. A published page can be copied, indexed or cached by others. Anyone holding a shared preview link may be able to access its permitted content until you revoke it or it expires. Use previews carefully and do not publish confidential information. Unpublishing does not erase copies already made by third parties.
4. Forms and audience information
If you collect visitor information, you must identify yourself as the recipient, provide an appropriate privacy notice, select a lawful purpose and collect only what you need. Obtain and keep any required marketing permission separately from an enquiry. Honour withdrawal, access and deletion requests and protect exports outside Linkella.
Do not use Linkella forms for passwords, full payment-card details, government identity documents, health records or other highly sensitive information. Do not intentionally collect children's information. Form validation is not an antivirus or legal-compliance guarantee. You remain responsible for safely handling downloaded attachments.
Linkella processes audience data on your instructions where the DPA applies. We separately use limited information to operate and secure our service as described in the Privacy Policy. Neither an email submission nor acceptance of these Terms supplies permission for unrelated marketing.
5. Subscriptions and Paddle
The intended Plus launch price is USD $5 per profile per month, billed through an account subscription for purchased profile capacity. Purchases may precede publication. Unused or unpublished profiles do not pause charges. Checkout shows the authorised total, currency, taxes, billing frequency and applicable trial.
Eligible accounts may receive a 15-day card-required trial for one profile. A trial is not guaranteed to every account. Buying more than one profile or increasing capacity during a trial starts paid billing immediately after confirmation. Existing customers and other ineligible accounts pay as shown at checkout. Do not create accounts to evade trial eligibility.
Subscriptions renew monthly until cancelled. Paid capacity increases can result in an immediate prorated charge; decreases normally take effect at renewal and retain paid capacity until then. The confirmation screen states the financial effect. Profile counts do not grant Pro or team-management features.
Our order process is conducted by Paddle, our authorised reseller and merchant of record. Paddle is the seller for your purchase and handles payment collection, applicable transaction taxes, receipts and payment-related support. The applicable Paddle entity is identified in its checkout and Buyer Terms. Linkella remains responsible for providing its software. Paddle's Privacy Notice explains its own processing.
Paddle checkout and payment terms govern your transaction with Paddle. These Terms govern your use of Linkella. Neither agreement removes non-waivable rights or a more protective applicable promise. We do not receive your full card number or card security code through the checkout integration.
We sell Linkella software subscriptions. We do not operate a marketplace or collect and pay out a creator's customer purchases through our Paddle account. External shops have their own sellers, payment terms and refund routes.
6. Cancellation, refunds and expiry
You can cancel through the account Billing controls, Paddle's portal or Paddle buyer support at paddle.net. Normal cancellation prevents the next renewal and takes effect at the displayed period or trial end. Keep the confirmation. Contact us or Paddle promptly if the cancellation route fails.
Our Refund Policy offers a 14-calendar-day request window after each charge, including renewals, subject to evidence-based fraud checks and applicable rights. Cancellation and a refund request are separate; tell us if you want both.
Public publishing, hosted profile access and subscription-dependent QR/short-link destinations require a current entitlement. Access can stop when a subscription expires, a payment becomes overdue, a subscription is paused or cancelled, or capacity is reduced. Do not rely on printed QR codes working indefinitely after access ends. A static QR that directly encodes an independent external URL is governed by that destination's availability.
7. Service limits and changes
Use Linkella within your purchased capacity and the limits disclosed before purchase. It is not a general file host, bulk email service or arbitrary redirect network. The Acceptable Use Policy explains resource misuse and proportionate enforcement. Normal legitimate popularity alone is not abuse.
We use reasonable care to provide the service. We do not promise uninterrupted availability, a particular search ranking, exact analytics, sales, leads or a service-level agreement. Third-party systems, blocked requests and bot filtering can affect measurements and delivery. Maintain independent copies of important content and audience exports; this does not remove our responsibility for reasonable security and care.
We may make maintenance, security and product changes. For material reductions to paid features or increases in recurring prices, we will give at least 30 days' advance notice and apply price changes no earlier than an eligible renewal, unless law requires longer notice or fresh agreement. If a material reduction prevents us supplying the paid service as agreed, contact us for an appropriate remedy, which may include a refund for the affected unused period. Urgent legal or security changes may need to take effect sooner.
8. Restrictions and appeals
We may restrict a page, link, form or account to address a breach, security threat, unlawful material or binding legal requirement. We will use a measure proportionate to the risk and, where lawful and practicable, explain the reason and allow correction. Serious or urgent harm may require immediate action.
You may challenge a decision through the reporting and appeals process. Making a complaint or requesting a lawful refund is not itself abuse. Suspension does not erase mandatory refund or consumer rights. We may terminate persistent or serious breaches after review.
9. Ending the agreement and deleting data
You may stop using Linkella, cancel renewal and request account deletion. Cancel your Paddle subscription before deleting your Linkella account. Deleting an account currently does not automatically cancel Paddle billing. If you cannot access billing, use your Paddle receipt or contact paddle.net and [email protected].
Deletion disables the account and public pages. Permanent deletion may begin after 30 days and can take longer. This is not a guaranteed recovery period. We may retain limited records for legal duties, payments, disputes or fraud prevention, as explained in the Privacy Policy. Contact us for the timing of your deletion request. Export needed information before deletion. The Privacy Policy explains retained records and backup limitations.
If we discontinue the service, we will give reasonable notice and an opportunity to export where practicable. We will resolve any prepaid undelivered service according to applicable law and this agreement. Clauses needed for completed transactions, protected rights, disputes and lawful retention survive termination.
10. Intellectual property and third parties
Linkella's software, branding and original materials belong to their respective owners. Your subscription grants a limited right to use the service during authorised access; it does not transfer those rights. Open-source and third-party components remain subject to their applicable licences. Statutory interoperability or other protected rights are not excluded.
Third-party links, embedded services and external transactions are controlled by their respective providers. Linking does not imply endorsement. Their practices may differ, and you should review their terms. This does not exclude liability we cannot lawfully exclude for our own conduct.
11. Liability
Nothing limits liability that cannot lawfully be limited, including liability for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence where protected by law. Nothing removes statutory guarantees, privacy remedies or consumer redress.
For consumers, we remain responsible for reasonably foreseeable loss caused by our breach or failure to use reasonable care, subject to applicable law. We are not responsible for losses unrelated to our breach or events outside our reasonable control where law permits that exclusion.
For business customers only, to the extent permitted by law, we exclude indirect or consequential loss and loss of profit, revenue or business opportunity. Our total liability arising from the service in any 12-month period is limited to the greater of fees paid or payable for that period and USD $100, except for liabilities that cannot lawfully be limited. Related claims are not multiple liability caps. These limitations do not reduce payment/refund obligations or override mandatory data-subject rights.
12. Complaints, law and changes
Contact [email protected], addressed to Ruchir Harbhajanka, with the subject “Complaint” or “Legal notice”. We will investigate and respond under applicable deadlines. You do not have to complete our internal process before using a remedy available by law.
Indian law governs this service agreement, subject to mandatory protections in a consumer's home jurisdiction. Business disputes may be brought in courts with competent jurisdiction in Kolkata, India. Consumers retain any right to use their local competent courts and consumer authorities. Paddle purchase disputes are addressed under Paddle's Buyer Terms.
We will identify the effective date of revised Terms and notify account holders of material changes at least 30 days before they take effect, except urgent legal or security changes. Changes are prospective. Where required, we will seek fresh acceptance; continued use is not a substitute for consent that law requires. You may cancel before an adverse change takes effect without losing existing refund rights.
